You can make a claim for pain, suffering, disability and many other kinds of losses against the other person’s insurance, if you can prove the other person's fault was greater than your own.  Just remember to exchange information after the accident including getting their insurance companies information.  Do not sign any forms or talk to an adjuster or insurance company representative.  You are not obligated to do this and it could end up hurting your case.
